Upon signing an employment contract under the Labor Code of the Republic of Azerbaijan, an employee is entitled to:
- Request changes or termination of contract terms;
- Work in conditions ensuring safety, health protection, and compliance with labor standards, and demand such conditions;
- Receive wages not lower than the legally established minimum;
- Refuse tasks or services outside their defined employment role in the contract;
- Request additional compensation for tasks or services beyond their contract;
- Work within the legally set working hours;
- Receive overtime pay or additional compensation for hours worked beyond the regular schedule;
- Take paid leave, as well as additional, social, unpaid, and educational leaves as applicable;
- Claim compensation for any work-related damage to property or health;
- Be covered by mandatory social insurance and other types of insurance as stipulated by law;
- Access additional rights and entitlements as legally provided.
When no employment contract exists, or an employee is engaged through a civil contract despite being in an actual labor relationship, they are deprived of the rights and benefits established by law. This can expose the employer to administrative or criminal liability. Only those employed under an employment contract are eligible for the benefits provided by law. Therefore, individuals working without a contract or under a civil contract are not entitled to these legal protections and privileges.
If the employment continues past the contract’s expiration and neither party requests termination within one week, the contract is deemed extended for the original term. When a fixed-term contract is terminated, the employee must receive wages for days worked up to the termination date and compensation for any unused leave days.
An employer cannot terminate an employee solely for reaching retirement age. Dismissal on these grounds is allowed only for employees in state-funded organizations reaching the mandatory retirement age of 65, as per Article 10 of the Labor Code. In other sectors, reaching retirement age does not justify termination unless initiated by the employee. Termination for retirement age is only permitted at the employee’s written request; otherwise, employees who reach retirement age remain protected under their employment contract.
To sign an online employment contract, the employer uploads the contract to the "Labor and Employment" subsystem, and the employee must:
- Log into their personal account on the ƏMAS platform (Labor and Employment Subsystem);
- Select “Online Employment Contract,” go to “Online Employment Contract Registry,” and choose “Contracts Pending Approval”;
- Review the contract and then choose to sign, reject, or return it;
- To finalize the signing, complete the process with a digital signature in the subsequent section.
